• “Company”, “We”, “Us” or “Our” refers to X4plore, a Proprietary business in India, with GST Reg No. 33ATZPJ3240P1Z2, Trade Name “X4plore”, legally represented by Mr. SANKARANARAYANAN JANAKIRAMAN as the Proprietor and Founder.
• “User(s)”, “You”, “Your”, “Yourself” refers to the individual/organization accessing, using or buying the Services.
• ”Services” refers to the Company’s sites, software products or any other technical service availed by You from the Company.
• “Software” refers to the Company’s software that can be downloaded from Our site and installed and used in a Device.
• “Device” refers to the hardware device like desktop, laptop etc., where You download and run the Company’s software.
• “T&C” means this Terms and Conditions document that You agree to regarding the access, install or use of Our Services

2. Accepted Use

Services provided by Us may only be used for lawful purposes. You agree to comply with all the applicable laws, rules and regulations in connection with Your use of Our Services. Any material or conduct, that in Our judgement, violates this T&C in any manner may result in suspension or termination of the Services and/or removal of the User's account with or without notice.
Users must be at least 13 years old to use Our Services. Users under 18 must use Our Services only under the supervision of their parent or guardian.

3. Prohibited Use

You may not use the Services to publish content or engage in any activity that is illegal under applicable law, that is harmful to others or that would subject Us to liability, including, without limitation , in connection with any of the following:

• Publishing or engaging in identity theft
• Distributing computer viruses, worms, Trojan horses or malicious code
• Distributing pornography or adult related content
• Promoting or faclilitating violence or terrorist activies
• Infringing Intellectual Property or other proprietary rights of others
• To create any unsolicited or unauthorized advertising, promotional material or other forms of spam

In addition, You cannot do any of the following:

• Copy, change, use or remove, any content that is posted on the site including logo, text, pictures, videos, legal documents, trademark, copyright or any other Intellectual Property
• Use the Service to expose proprietary or confidential information of a third party or Yourself that is not intended to be shown to the world
• Web Scraping or Web Crawling, automated or manual, to access, view and collect information
• Reverse-engineer, disassemble, decompile, modify or create derivative work

4. No Warranty

Our Services are provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. The Company expressly disclaims warranties of all kinds whether express, implied, statutory or otherwise. Without limitation to the foregoing, the Company provides no warranty that the Services will meet Your requirements, achieve any intended results, operate without interruption, may any other performance or reliability standards or be error free or that any errors or defects will be corrected.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use Our Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this T&C), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this T&C and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You to the Company for the Service.

6. User Registration

User’s registering on Our site must note that:

• User must keep his/her credentials confidential and are responsible for keeping their usernames and passwords safe from others
• If a User believes that someone has gained unauthorized access to their account or if their credential gets stolen, he/she must contact Us immediately.

7. Enforcement

We take the breach of this T&C very seriously and in such a case, We may take the following actions:

• Issue of warning
• Immediate, temporary or permanent withdrawal of Your right to use Our Services
• Suspend or Cancel Your payment orders take other such actions as We consider necessary
• Legal action against You including proceedings for reimbursement of all costs on “all expenses” basis
• Reporting and disclosure of information to law enforcement authorities

8. Indemnification

You agree to indemnify and hold the Company and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of Your: (a) use of the Services; (b) violation of this T&C or any law or regulation applicable; or (c) violation of any right of a third party.

9. Intellectual Property Notice

By accessing, installing or using Our Service any form, You agree that:

• The Company owns all the content posted on the site, including but not limited to, logo, text, pictures, videos, documents, trade mark, copyright, other protected ideas and any other Intellectual Property
• You will not use, sell, modify, rent, loan, share or distribute any of the above mentioned in any way

11. Pricing

We offer Our Software in 3 kinds of subscription models:

• MONTHLY: Monthly subscription offers Our Software on a monthly basis(calendar month) by the end of which access to the Software installed on Your Device will be revoked. To continue having access to the Software installed on Your Device, please subscribe regularly before the end of the period. Our pricing is Rs.4000/month/Device.
• TERM: Term subscription offers Our Software on a 3-months(calendar month) term basis by the end of which access to the Software installed on Your Device will be revoked. To continue having access to the Software installed on Your Device, please subscribe regularly before the end of the period. Our pricing is Rs.10000/3-months/Device.
• BUSINESS: If You are a business or an institution and want technical service in addition to Our Software, please write to Us at janakiraman@x4plore.com. After further discussion, pricing will be proposed based on the requirement presented by the business or institution.

12. Refund and Cancellation

Please check the Refund or Cancellation Policy document present in Our site for in-depth information about refund and cancellation.

13.Correction

Users must take note that there might be some typographical errors, inaccuracies, omissions etc., in the descriptions, pricing, availability and various other information posted on Our site.
We reserve the right to correct any errors, inaccuracies or omissions and to change or update information on Our Services at any time, without prior notice.

14. Modification and Interruptions

We reserve the right to change, modify or remove any content or Service from time to time for various reasons, including but not limited to, update Our offerings, to comply with the new laws or regulations etc., We also reserve the right to modify or discontinue Our Services if We decide to change the Company’s business offering or if We decide to close down. We will not be liable to You or any third party for any modification, suspension, discontinuation of Services or price change of Services.
We cannot guarantee that Services will be available at all times. We may experience hardware, software or other kinds of failures/problems or may need to perform maintenance related activities. This may result in errors, delays or interruptions to Our Services from time to time. We reserve the right to revise, change, update, suspend, discontinue or otherwise modify the Services from time to time and will endeavor to give You notice of such changes.
You agree that We have no liability whatsoever for any loss, damage or inconvenience caused by Your inability to use Our Service during downtime or discontinuation of Service. Nothing in this T&C can be construed to obligate Us to maintain and support the Services or to supply any corrections, updates or releases in connection to Our Service.

15. Term and Termination

This T&C comes into effect automatically when You start to access, use, download or install any of Our Service and ends when it is terminated by either You or the Company.
Even if the term of this T&C ends, it will not limit any of the Company's rights or remedies at law or in equity in case of breach by You (during the term of this T&C) of any of Your obligations under the present T&C.

15.1. Termination by You

We would hate to see You go but should You decide to terminate Your account with Us, You can write to Us any time to janakiraman@x4plore.com, stating the intent along with details of Your Name, UserName and Email ID that You used for new user signup. Your query will be answered and Your account termination will be done within 5 days (6 days if a Sunday falls within that period). Once the termination request is processed, Your details will be erased from Our storage.

15.2. Termination by Us

We may terminate or suspend Your account and Your access to the Services should We have reason to believe You, Your content or Your use of Our Service violates Our T&C. In that case, please understand that You don’t have a contractual or legal right to continue to use Our Service.

16. Changes to T&C

The Company reserves the right, at its sole discretion, to modify, revise, update or replace this T&C at any time. In such cases, We will endeavor to notify You of the changes. To make sure that You stay updated with this T&C, please visit Our site frequently and read this document.
By continuing to access, use or buy Our Services or Software after any revisions become effective, You agree to be bound by the revised terms. If You do not agree with the revised terms, please stop accessing or using all of Our Services and/or Software and notify Us immediately that You are intending to terminate Your association with Us.

17. Acknowledgement

By accessing, buying, installing and/or using the Company’s site, Software or Service, You agree and acknowledge that You are aware of the Terms and Conditions as mentioned in this T&C document.
If You are not willing to agree with the Terms and Conditions stated in this T&C document, please DO NOT access, use, buy or install Our Services or Software.
